Published Cases:

Oufafa v. Taxi, LLC, et al., 664 S.W.3d 592 (Ky. 2023). Andrew’s client was a taxi driver who was robbed and shot by a passenger, leaving him paralyzed. The taxi company claimed they did not have to pay workers’ compensation benefits because he was an independent contractor not an employee. The ALJ initially ruled in favor of the taxi company. After receiving the ALJ ruling against his client, Andrew vigorously fought to change the law in favor of his client and all Kentucky workers. 


After Andrew appealed his client’s case all the way to the Supreme Court of Kentucky, the Court reversed the ALJ’s decision and adopted the new “economic realities test” for determining whether a worker is an employee or independent contractor. This permanently changed the law in Kentucky for the benefit of workers. On remand, the ALJ found that all six factors of the new test were in favor of Andrew’s client and determined he was an employee and entitled to workers’ compensation benefits. 


 

PRACTICE CONCENTRATION:

 

  • Employment Law & Federal Employee Rights.  Andrew zealously represents private,  federal, and other government employees for claims including Merit System Protection Board (MSPB) proceedings, wage and hour claims, FLSA collective actions, sexual harassment claims, whistleblower actions and retaliation, qui tam false claims act, Title VII and Kentucky Civil Rights Act discrimination claims, EEOC proceedings, class actions, wrongful termination, hostile work environment, unemployment insurance appeals, arbitrations, and non-compete agreements. In the past, Andrew has represented both employees and employers in employment disputes which provides him with a litigation advantage when pursuing employment related claims.   • Prisoners' Rights & Excessive Force Claims. Andrew represents victims of civil rights violations while incarcerated or by law enforcment personnel in the following types of matters: Police Misconduct, Deadly Force, Excessive Force, Police Shootings, Jail Neglect and Abuse, and Police Dog Attacks.


  • Small Business Litigation & Administrative Defense. Andrew worked his way up in the restaurant industry from washing dishes to general manager. This past work experience instilled a strong work ethic which is evidenced by Andrew’s extreme preparation before every deposition, hearing, and trial. Andrew also represents local small businesses in administrative proceedings including with the ABC, Energy and Environment Cabinet, EEOC, and the Labor Cabinet.
